 In these conditions the following words have the following meanings unless the context requires otherwise: The term “Agreement” for purposes of this website is defined as an agreement between Yourself (the user) and Us (the website).  Specifically, this agreement signifies the understanding and acceptance of these terms and conditions for the provision of this service.

The terms “You, Your, Yourself, or Member/s” are defined as the person who is applying for the service offered by Us, and who is agreeing to all of Our “Terms and Conditions.”

Welcome to IndianKarma.com, the newest and easiest to use, on-line service for Indians to meet and connect with each other.  This site is owned and operated by IndianKarma.com.  By using the IndianKarma.com Website you are consenting to abide by all of these Terms of and Conditions of Use (this “Agreement”), whether you have registered as a member or not.  If you wish to become a Member of InidanKarma.com in order to communicate with other Members and access the Service offered by IndiaKarma.com, please read the following Terms of Use and indicate your acceptance of them by following the instructions in theRegistration Process.

This Agreement states and defines all of the legally binding terms of your use of the IndianKarma.com Website.  Your membership in the IndianKarma.com Service may be subject to periodic modifications by IndianKarma.com; such modifications to be effective upon posting of these modifications on the IndianKarma.com Website.  By agreeing to IndianKarma.com’s “Terms of Use,” you are agreeing to IndianKarma.com’s Acceptable Use Policy for Content (posted on the Website), IndianKarma.com’s Privacy Policy, and any notices regarding the Website.  If you would like to receive a copy of this Agreement, please e-mail us at:support@indiankarma.com, Subject: Terms of Use Agreement. 

1. Eligibility.  In order to use this Website, you must be 15 years of age or older; however, ADULTS may serve as representatives for their own children.  Membership in the Service is void where prohibited.  By using this Website, you are representing that you have the right, authority, and capacity to enter into this Agreement, and are required to abide by all of the terms and conditions of this Agreement.  

2. Term.  The Agreement with IndianKarma.com will remain in effect while you use the Website or are a member of the Service provided by them.  Members reserve the right to terminate their membership with IndianKarma.com at any time, for any reason.  In order to terminate membership with IndianKarma.com, members must send written or electronic (via e-mail) notice of termination to IndianKarma.com.  Please NOTE: based on the nature and services provided by IndianKarma.com, NO REFUNDS WILL BE GIVEN AT ANY TIME FOR ANY REASON.  IndianKarma.com retains the right to terminate membership for any reason.  Termination of membership will be effective upon sending notice to the member via e-mail (to the e-mail address provided by You, the member, either in your application or any other e-mail addresses provided), without any refund of any currency.  If your membership with IndianKarma.com is terminated due to a breach of the Agreement, then you will not be entitled to any refund of unused subscription fees.  Additionally, the Agreement with IndianKarma.com will remain in effect even after the membership with the User has been terminated.  Specifically, certain provisions of the Agreement will remain in effect, including sections: 4, 5, 7, and 9-14 of this Agreement.

3.  Non Commercial Use by Members.  The IndianKarma.com Website is designed for the personal use of its members ONLY and may NOT be used in connection with any commercial endeavors.  IndianKarma.com does not allow organizations, companies, and/or businesses to become members, not use the Website for ANY reason or purpose.  ANY unauthorized or illegal use of the IndianKarma.com Website, including the collection of usernames or e-mail addresses of members by any means for the purpose of sending unsolicited e-mails or unauthorized framing of or linking to the website is prohibited.  Any unauthorized or illegal use of this Website will be investigated and prosecuted to the fullest extent; including, without limitation, civil, criminal, and injunctive redress.  

4. Proprietary Rights in Content on IdianKarma.com.  All proprietary rights in the Website and the Service of the IndianKarma.com Website are owned IndianKarma.com.  

5. Content Posted on the Site.

a.	The messages and content posted on IndianKarma.com are subject to review by IndianKarma.com.  By using the Website/and or becoming a Member, you understand and agree that IndianKarma.com may review and delete any content messages, IndianKarma.com Messenger Messages, and photos or profiles.  IndianKarma.com has the right to delete any messages or content (including photos) that violate this agreement that may be considered illegal, offensive, or pose a threat to the safety of its members.  IndianKarma.com reserves the sole right to determine which messages or content is unacceptable or is in violation of the Agreement.
b.	By accepting the terms of this agreement, you are acknowledging sole responsibility for any and all messages or content that you post or display on the Service or transmit to other Users or Members.
c.	Please be aware that by posting content or messages on any public area of IndianKarma.com, you acknowledge that you grant and represent and warrant that you have the right to grant to IndianKarma.com an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute any type of content and such information (including in personal communications).
d.	The list below contains examples of the type of content that is illegal or prohibited on the IndianKarma.com Website.  Such illegal or prohibited content will be removed or deleted from IndianKarma.com and will be further investigated and prosecuted (in appropriate cases).  Members who violate the Agreement with IndianKarma.com and post illegal, inappropriate, or prohibited content will be terminated from membership with IndianKarma.com WITHOUT ANY TYPE OF REFUND.   Example of prohibited content include any material or content that is: Pornographic or considered to be pornographic. Harmful or designed to cause harm to another person Threatening to the community or an individual Harassing or that advocates the harassment of an individual.  Examples include content that contains or promotes racism, bigotry, hatred, the exploitation of women or children, or an implied or direct threat of physical harm. Anything considered to be obscene or patently offensive to the on-line community. Promoting misinformation or information known to be false is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;  Material that exploits children under the age of 18 in a sexual or violent manner, or solicits personal information from a minor (under the age of 18). Soliciting of passwords or personal identifying information from users for commercial or unauthorized use and that engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes. Advocating or promoting criminal or illegal activities, such as invasion of privacy, the sale of narcotics, buying or receiving stolen goods, and so forth. Promoting plagiarism or the unauthorized use of another person's copyrighted work.
e.	Use of the IndianKarma.com Website must be in accordance with any local, state, federal, or applicable law. Illegal use of the Website is strictly prohibited.
f.	f. You may not include any street addresses, telephone numbers, last names, URLs or e-mail addresses in your member profile.
g.	Advertising to, solicitation of other members of the IndianKarma.com service by you is strictly prohibited. You may not buy or sell products or services through the service provided by IndianKarma.com. You are not allowed to transmit any chain letters or junk e-mail to other members of the IndianKarma.com service. While IndianKarma.com is unable to monitor the conduct of its members outside of the Website or service, it is a violation of the Agreement to use information obtained from the service for purposes of harassment, abuse, harm to another person, to contact, advertise to, solicit, or sell to any member without their prior consent or request.

6. Copyright Policy. It is prohibited to distribute, post, copy, or reproduce any copyrighted material, trademarks, or other proprietary information without the prior written consent of the owner of the proprietary rights. If you feel that your proprietary rights have been violated or if your work has been copied, distributed or posted on the IndianKarma.com Website or Service, please contact us at: copyright@indiankarma.com.

7. Subscription. Youmay sign up for numerous subscriptions to IndianKarma.com, however, please be aware that you will be limited to one instance of IndianKarma.com Messenger only. .

8. Member Disputes. While IndianKarma.com has the right to monitor content, including disputes between you and other members, it is not obligated to interfere. You, the user or member is solely responsible for your own conduct and interactions with other IdianKarma.com members.

9. Privacy. Use of the IndianKarma.com website and or/ the service is governed by our Privacy Policy

10. Disclaimers. IndianKarma.com is not responsible for any incorrect or inaccurate Content posted on the Website or in connection with the Service, whether caused by users of the Website, Members or by any of the equipment or programming associated with or utilized in the Service. IndianKarma.com is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Service. IndianKarma.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. IndianKarma.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Website or combination thereof, including injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service. Under no circumstances will IndianKarma.com be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Website or the Service, any Content posted on the Website or transmitted to Members, or any interactions between users of the Website, whether online or offline. The Website and the Service are provided "AS-IS" and IndianKarma.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. IndianKarma.com cannot guarantee and does not promise any specific results from use of the Website and/or the Service.

11. Limitation on Liability. Except in jurisdictions where such provisions are restricted, in no event will IndianKarma.com be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Web site or the Service, even if IndianKarma.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, IndianKarma.com’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to IndianKarma.com for the Service during the term of membership.

13. Disputes. If there is any dispute about or involving the Website and/or the Service, by using the Website, IndianKarma.com exists solely within the state of California. I agree that regardless of where I reside or where my browser is physically located, my viewing and use of IndianKarma.com occurs solely within the County of Los Angeles in the State of California, and that all content and services shall be deemed to be served from, and performed wholly within, Los Angeles, California, as if I had physically traveled there to obtain the service. I agree that California law shall govern any disputes arising from my use of this website, and that the courts of the city of Los Angeles, state of California, shall have exclusive jurisdiction over any disputes.

14. Indemnity. You agree to indemnify and hold IndianKarma.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

15. Other. This Agreement, accepted upon use of the Website and further affirmed by becoming a Member of the Service, contains the entire agreement between you and IndianKarma.com regarding the use of the Website and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
